Terms of service

These Terms of Service govern your use of the North & Ever website and any purchases made through our online store. By visiting our website, placing an order, or otherwise using our services, you agree to these Terms.

North & Ever is operated in Alberta, Canada. Throughout these Terms, “North & Ever,” “we,” “us,” and “our” refer to North & Ever and its owners or operators.

Online store terms

You must be able to legally enter into a purchase agreement in your jurisdiction to place an order through our store.

You may not use our products, website, or services for any unlawful or unauthorized purpose. You may also not attempt to interfere with the security, functionality, or operation of our website.

We reserve the right to refuse service, cancel an order, or limit quantities where reasonably necessary, including in cases of suspected fraud, misuse, pricing errors, inventory issues, or violations of these Terms.

Products and availability

North & Ever offers made-to-order embroidered apparel, including Custom Collection products and Signature Drops.

We make reasonable efforts to display product colours, artwork, sizing, descriptions, and other details accurately. However, colours may appear differently depending on your screen, and finished embroidery may vary slightly because embroidery is a physical production process.

Product availability may change without notice. We may discontinue or modify products, designs, colours, sizes, pricing, or customization options at any time.

Custom Collection orders

Custom Collection products are created using information and materials you provide, which may include photographs, artwork, handwriting, names, dates, phrases, locations, colours, and other personalisation details.

You are responsible for reviewing the information you submit and ensuring it is accurate before placing your order.

By submitting content to North & Ever, you confirm that you own the content or otherwise have the necessary permission to provide it to us and to have it reproduced as part of your order.

You also authorize North & Ever to modify, simplify, trace, digitize, crop, resize, recolour, or otherwise adapt submitted content as reasonably necessary to create an embroidery-ready design.

Embroidery has technical limitations. Fine details, colours, facial features, backgrounds, textures, and other elements may need to be simplified or adjusted to achieve a clean finished result.

Submitted photographs and artwork

You retain ownership of the photographs, artwork, and other original content you submit.

You grant North & Ever a limited licence to use that content for the purpose of designing, producing, fulfilling, and supporting your order.

If you voluntarily submit a story or other content through a field that specifically explains it may be used in North & Ever behind-the-scenes, social media, or brand content, you give us permission to use that submitted story for those purposes.

We will not intentionally publish your personal contact information as part of such content.

You are responsible for ensuring that content you submit does not infringe another person's copyright, trademark, privacy, publicity, or other rights.

Prohibited custom content

We reserve the right to decline any custom order that contains content we reasonably consider unlawful, infringing, threatening, hateful, discriminatory, sexually exploitative, or otherwise inappropriate for North & Ever to reproduce.

If we are unable to fulfil an order for this reason and production has not begun, we will determine the appropriate cancellation or refund based on the circumstances.

Digital design proofs

Where offered, a digital design proof may be purchased as an optional add-on.

A proof provides an opportunity to review the proposed embroidery design before production and includes the number of revisions stated on the product page.

You are responsible for reviewing the proof carefully, including spelling, names, dates, placement, general design, and other visible details.

Once you approve a proof, North & Ever may begin production. Changes requested after approval may not be possible and may result in additional charges or production delays.

Digital proofs are representations of the intended design. Minor differences between a digital proof and the finished embroidered product may occur due to thread, fabric, garment colour, stitch behaviour, and the embroidery process.

Signature Drops

Signature Drop products feature North & Ever designs with customer-selectable options such as wording style, garment colour, and size.

You are responsible for confirming your selected design style, garment colour, and size before completing your purchase.

Because Signature Drop products are produced specifically for each order, they are subject to our Return and Refund Policy.

Pricing and payment

All prices are shown in the currency displayed on our website unless otherwise stated.

Applicable taxes and shipping charges are calculated during checkout.

We reserve the right to change product prices at any time. A price change will not affect an order that has already been accepted, except where there is an obvious pricing or technical error.

Payment must be successfully authorized before we begin processing an order.

Order acceptance

Submitting an order does not necessarily mean that we have accepted it.

We may contact you if additional information is required to complete your order, including questions related to uploaded artwork, image quality, customization details, payment, or shipping information.

We may cancel an order if we cannot reasonably produce it, an item becomes unavailable, payment cannot be verified, a material pricing error has occurred, or the order otherwise cannot be fulfilled.

If we cancel an order after payment has been collected and no amount is properly owing for work already completed, the appropriate refund will be issued.

Production times

North & Ever products are made to order.

Estimated production times are shown on our product pages. These estimates begin once we have the information needed to produce your order.

Orders requiring a digital proof may take additional time because production cannot proceed until the proof process has been completed.

Production estimates are not guaranteed delivery dates.

Shipping and delivery

Shipping transit time is separate from production time.

Once an order has been completed and shipped, tracking information will be provided where applicable.

Carrier delivery estimates are outside North & Ever's direct control and may be affected by weather, service disruptions, remote destinations, peak periods, or other circumstances.

Customers are responsible for providing a complete and accurate shipping address.

Additional costs caused by an incorrect or incomplete address supplied by the customer may be the customer's responsibility.

Returns, refunds and cancellations

Because our products are made to order, Custom Collection and Signature Drop products are generally final sale.

Returns, exchanges, cancellations, damaged items, order errors, and approved refunds are governed by our Return and Refund Policy.

Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer protection laws.

Intellectual property

Unless otherwise stated, the North & Ever name, logos, website content, product photography, graphics, Signature Drop artwork, illustrations, product descriptions, branding, and original designs are owned by or licensed to North & Ever.

You may not reproduce, copy, distribute, modify, manufacture from, commercially exploit, or use North & Ever intellectual property without our prior written permission.

Purchasing a product does not transfer ownership of the underlying North & Ever design or artwork.

Third-party services

Our store may use third-party services such as Shopify, payment processors, shipping carriers, analytics providers, customization applications, and other service providers necessary to operate the business.

Your use of certain third-party features may also be subject to their own terms and privacy practices.

We are not responsible for third-party websites or services that we do not control.

Accuracy of website information

We make reasonable efforts to ensure the information on our website is accurate and current.

However, occasional errors may occur in product descriptions, pricing, promotions, availability, shipping information, or other website content.

We reserve the right to correct errors, update information, or cancel an affected order where reasonably necessary.

Promotions and discount codes

Promotions, discount codes, and special offers may be subject to separate conditions, expiry dates, minimum purchase requirements, product exclusions, or usage limits.

Unless otherwise stated, discounts cannot be combined.

We may modify or end a promotion at any time, subject to applicable law.

Limitation of liability

To the extent permitted by applicable law, North & Ever will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from content you submit where you did not have the legal right or permission to provide that content for reproduction.

This includes claims relating to copyright, trademark, privacy, publicity rights, or other third-party rights.

Privacy

Your submission of personal information through our store is governed by our Privacy Policy.

This includes information provided during checkout and information submitted as part of custom orders.

Changes to these terms

We may update these Terms of Service from time to time to reflect changes to our products, services, business practices, website, or legal requirements.

The version posted on our website at the time of your purchase will generally apply to that transaction.

Governing law

These Terms are governed by the applicable laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without limiting any mandatory consumer rights that may apply based on your location.
